1. Introduction and Acceptance
Welcome to QLead, accessible at https://www.qlead.ai.
QLead is a brand owned and operated by AOB India Private Limited, a company incorporated under the laws of India.
These Terms and Conditions ("Terms") govern access to our website, AI-powered lead-generation services, qualification technology, client dashboards, marketing infrastructure, and related services.
By using our website or expressly accepting these Terms, you agree to be bound by them.
Business clients purchasing services may also be required to execute a Service Agreement, Statement of Work, quotation, or Order Form.
In the event of a conflict, the specifically negotiated and accepted Service Agreement or Order Form shall prevail regarding the purchased services, fees, deliverables, and service-specific obligations.
2. Nature of Business
QLead provides technology-enabled B2B marketing, lead-generation, prospect qualification, sales outreach, and meeting-generation services.
Depending on the engagement, these may include:
AI-powered qualification through QBot.
Lead Qualification Criteria configuration.
Campaign planning and deployment.
Landing-page and marketing creative development.
Prospect identification and outreach.
Human qualification and reconfirmation where included.
Qualified prospect and meeting facilitation.
Client dashboards and campaign reporting.
Related marketing automation and operational infrastructure.
QLead provides professional services and technology-enabled business solutions, not guaranteed sales or revenue outcomes.
3. Business Eligibility
Our services are intended for lawful business and professional use.
By purchasing services, you represent that you are authorized to act on behalf of the purchasing business, that the information supplied is accurate, and that the intended campaign complies with applicable law.
QLead reserves the right to reject or discontinue prohibited or unlawful campaigns.
4. Service Engagement and Order Forms
Each paid engagement shall be governed by a quotation, Order Form, Service Agreement, or other accepted commercial document identifying the applicable service scope.
The commercial document may specify:
Services and infrastructure included.
Target audience and geography.
Lead Qualification Criteria.
AI-only or AI-plus-human qualification.
Indicative or expressly committed lead quantities.
Campaign timelines and activation requirements.
Fees, billing milestones, and currency.
Applicable lead replacement or service-credit terms.
Client dependencies and required approvals.
Marketing materials, website descriptions, and illustrative case studies do not independently create a guarantee beyond the expressly agreed commercial commitments.
5. Infrastructure Setup and Activation
QLead may deploy customized infrastructure comprising QBot configuration, landing pages, qualification workflows, campaign creatives, CRM integrations, reporting access, and operational resources.
Where a package includes setup or activation fees, such fees compensate QLead for the work and resources described in the applicable Order Form.
Services may commence following payment and receipt of required client information.
Infrastructure activation or completion shall be evidenced by relevant deployment records, configuration records, access details, work products, or other reasonable documentation.
Payment alone does not establish that services have been fully performed.
6. Lead Qualification Criteria
The Lead Qualification Criteria ("LQC") define the objective requirements against which prospects are assessed.
These may include business category, target persona, location, product or service requirement, budget, purchasing timeline, or other approved qualification parameters.
Clients must review and approve the applicable LQC before campaign activation.
Changes to approved criteria may require campaign adjustments, additional work, revised pricing, or written agreement.
Qualification shall be evaluated against the criteria applicable when the prospect was assessed.
7. Qualified Leads and Qualification Process
A Qualified Lead is a prospect meeting the qualification definition expressly set out in the applicable Order Form.
The exact process must be stated in the Order Form.
A prospect's subsequent refusal to purchase, delayed decision, change of circumstances, or inability to convert does not automatically invalidate qualification previously established in accordance with the agreed criteria.
QLead does not guarantee that every prospect will become a paying customer.
8. Lead Sources and Campaign Transparency
QLead may use lawful combinations of advertising platforms, professional databases, public business information, permitted third-party data providers, direct response campaigns, email outreach, digital messaging, and other approved acquisition methods.
Not every engagement includes paid advertising or a publicly accessible advertisement URL.
Where a specific advertising campaign, landing page, channel, or source-reporting deliverable is expressly included, QLead will provide the agreed information or reasonable evidence of performance.
QLead may protect proprietary databases, confidential sourcing methodologies, trade secrets, platform credentials, and third-party personal information.
Such confidentiality does not relieve QLead of expressly agreed reporting or service-delivery obligations.
9. Client Obligations
Clients agree to:
Provide accurate business and campaign information.
Approve required marketing materials and qualification criteria.
Supply lawful product descriptions and marketing claims.
Obtain and maintain any permissions or consents allocated to them.
Use prospect information only for authorized purposes.
Comply with applicable privacy, advertising, messaging, and anti-spam laws.
Maintain appropriate internal follow-up and sales practices.
Promptly report suspected data-security incidents or service defects.
Avoid misleading, abusive, unlawful, or discriminatory conduct.
Clients are responsible for their own products, pricing, representations, and customer relationships.
10. United States Legal Compliance
QLead and its clients must comply with applicable federal and state laws, including relevant requirements under the CAN-SPAM Act, state privacy laws, applicable messaging and marketing laws, and other requirements governing business outreach and personal information.
The availability of business contact information does not, by itself, constitute legally sufficient authorization for every form of outreach.
QLead may suspend a campaign reasonably believed to present material legal or compliance risk.
Neither party is relieved of its own legal obligations by these Terms.
11. Fees and Payment
All applicable charges will be specified in the accepted Order Form, quotation, checkout page, or invoice.
Charges may include:
One-time infrastructure setup or activation fees.
Campaign management fees.
Qualification and operational service fees.
Platform access fees.
Recurring service fees.
Additional services approved by the client.
Unless otherwise specified, US-facing quotations may be denominated in US dollars (USD).
Clients authorize charges only under the billing terms disclosed and accepted at the time of purchase.
No undisclosed recurring payment obligation shall be imposed.
Taxes, where applicable, will be identified in accordance with relevant law.
12. Complimentary or Indicative Lead Allocations
Certain packages may include an indicative or complimentary lead allocation associated with a purchased infrastructure or campaign service.
Such allocations must be clearly described in the applicable Order Form.
An indicative allocation is not an unconditional guarantee of a fixed quantity unless the Order Form expressly makes it a committed deliverable.
Where a quantity or delivery period is expressly committed, the corresponding contractual obligations and remedies apply.
QLead shall not characterize an expressly promised deliverable as non-binding solely because it is described as complimentary.
13. Lead Disputes and Corrective Measures
Clients may report objectively disputed leads through digital@qlead.ai.
The report should identify the lead and the alleged deficiency, including failure to meet agreed LQC, inaccurate qualification evidence, duplication contrary to agreed terms, or other specified defects.
QLead will review available source records, qualification records, timestamps, platform activity, and relevant communications.
Where a lead is determined not to meet an expressly agreed qualification or replacement condition, QLead will provide the corrective remedy specified in the applicable Order Form.
The absence of a sales conversion alone does not establish a defective lead.
Nothing in this clause excludes remedies that cannot lawfully be waived.
14. No Guarantee of Business Outcomes
Unless expressly guaranteed in an accepted written agreement, QLead does not guarantee:
Sales or customer acquisition.
Revenue, profitability, or return on investment.
Prospect purchasing decisions.
Meeting attendance.
Contract execution.
Any specific downstream commercial result.
Actual results depend on market conditions, targeting, prospect behavior, pricing, follow-up, competition, and other factors.
This disclaimer does not excuse failure to provide expressly contracted services.
15. Refunds and Cancellation
Refunds, cancellations, and service credits are governed by the QLead Refund and Cancellation Policy and the applicable Order Form.
The Policy is available at:
Nothing in these Terms excludes non-waivable legal rights.
16. Intellectual Property
QLead's software, QBot technology, models, workflows, proprietary databases, qualification systems, methodologies, website materials, and other intellectual property remain the property of AOB India Private Limited or their respective licensors.
Clients receive only the access and usage rights expressly granted under the applicable agreement.
Clients retain ownership of their independently owned trademarks, content, and business materials.
Ownership or permitted use of client-specific creative deliverables shall be governed by the Order Form.
17. Confidentiality and Personal Information
Both parties must protect confidential information obtained during the engagement.
Personal information shall be processed in accordance with applicable law, the QLead Privacy Policy, and any applicable Data Processing Agreement.
Prospect information may not be used for unlawful outreach, unauthorized resale, or purposes outside the applicable permissions and agreement.
18. Third-Party Platforms
Services may depend on third-party advertising networks, CRM providers, hosting platforms, communication platforms, and payment processors.
QLead is not responsible for disruptions solely attributable to third-party providers beyond its reasonable control, except where QLead has expressly assumed responsibility or applicable law requires otherwise.
19. Suspension and Termination
QLead may suspend services for material non-payment, unlawful campaign activity, security threats, unauthorized use, or material contractual breach, subject to applicable notice and cure requirements.
Clients may request termination in accordance with their Order Form.
Termination does not automatically cancel amounts lawfully accrued for services already performed.
Any prepaid unused amounts will be handled under the applicable agreement, Refund and Cancellation Policy, and governing law.
20. Warranties and Disclaimers
QLead will perform expressly agreed professional services with reasonable care and skill.
Except for express contractual commitments and non-excludable legal obligations, QLead makes no warranty that the services will produce a particular commercial outcome or operate without interruption.
Any implied warranties are excluded only to the extent legally permitted.
21. Limitation of Liability
To the maximum extent permitted by applicable law, neither party shall be liable for indirect, incidental, special, or consequential damages, including lost profits or lost business opportunities, arising from the services.
Unless a separately signed agreement specifies another lawful limitation, QLead's aggregate liability arising from a paid service engagement shall not exceed the total fees actually paid to QLead under the affected Order Form during the twelve months preceding the event giving rise to the claim.
This limitation does not exclude liability that cannot lawfully be limited, including liability for fraud or intentional misconduct where such exclusion is prohibited.
Nothing in these Terms prevents either party from seeking remedies for proven material breach or other non-waivable rights.
22. Indemnification
Each party agrees to indemnify the other against third-party claims, losses, and reasonable costs to the extent arising from its own unlawful conduct, infringement of third-party intellectual property rights, material breach of applicable data-protection obligations, or material breach of its express contractual representations, subject to applicable law and the governing agreement.
No party shall be required to indemnify another for the latter's own fraud, willful misconduct, or unlawful acts.
23. Dispute Resolution
Parties shall first attempt in good faith to resolve service-related disputes by written communication to digital@qlead.ai.
The applicable signed Service Agreement or Order Form shall govern dispute resolution for paid services, including any agreed arbitration mechanism, governing law, and forum.
For website-use disputes not covered by a separate agreement, the laws of India shall govern, subject to applicable mandatory law and jurisdictional requirements, with courts at Hyderabad, Telangana having jurisdiction to the extent legally permissible.
Nothing in these Terms restricts lawful reporting to regulatory authorities, law enforcement, or the exercise of non-waivable statutory rights.
24. Electronic Acceptance
Where applicable, electronic acceptance, digital signatures, and online service confirmations may form binding agreements to the extent permitted by applicable electronic transaction laws.
QLead may maintain appropriate acceptance records, including timestamps and transaction references.
25. Modifications
QLead may revise these Terms from time to time.
Updated Terms will be published on www.qlead.ai.
Material changes affecting existing paid commitments will be handled according to the applicable agreement and law.
26. Severability
If any provision is found invalid or unenforceable, the remaining provisions shall continue in effect to the extent legally permissible.
